If it’s so easy to get into a timeshare contract, why is it so hard to get out? Here are a few reasons.
Once your contract is signed, you have a rescission period within which you can cancel your contract for any reason. This is a great solution for owners with instant buyers remorse. The right of rescission is the easiest way to say good-bye to your timeshare. However, most rescission periods are very short. Sometimes as short as five business days. So if your window has closed, you’ll need to find another way.
Once your rescission period has passed, you’re locked into your contract. And timeshare contracts tend to be very long. Sometimes they last forever. If you have a contract in perpetuity, it can last even beyond your death. While that’s great if your kids want to inherit your timeshare, it’s not so great if you want out.
Timeshare companies tend to be large, powerful, and well-connected. And most timeshare owners, well, aren’t. Most timeshare owners are just regular consumers. Unfortunately, getting rid of a timeshare can be harder than getting rid of those old VHS tapes. The truth is, the timeshare resale market is flooded with inventory. And it’s not flooded with buyers. In fact, you can find timeshares priced for pennies on the dollar of their original purchase price. Additionally, some timeshare companies are cracking down on the resale market and limiting benefits for owners who purchase through a third party.
In desperation, some owners try to give away their unwanted timeshares. Some companies do offer options such as deed-back programs that allow you to give back your timeshare. You don’t get any money for it, but most people are just happy to get out at all. Unfortunately, it can be difficult to qualify for these programs. For example, you usually have to have paid off the purchase price and be up to date on all maintenance fees and special assessments. And on top of that, your company has to approve you. Which they may not do if they don’t think they can easily find a buyer for your unit. You’re basically at their mercy.
